DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY, INJURE OR DAMAGE
CERTAIN PROPERTY OF THE OWNER/VICTIM TO WIT: A 1998 LATE MODEL
RACE CAR, IN VIOLATION OF FLORIDA STATE STATUTE 806.13

ON 030505, AT APPROXIMATELY 2250 HOURS, I WAS WORKING AN OFF
DUTY DETAIL AT THE CITRUS COUNTY SPEEDWAY. THE RACE HAD
MOMENTARILY STOPPED DUE TO AN ACCIDENT ON THE SPEEDWAY AND THE
DRIVER''S HAD SLOWED DOWN TO APPROXIMATELY 20 MILES PER HOUR.
THE DEFENDANT''S VEHICLE WAS INVOLVED IN THE WRECK ON THE TRACK,
WHICH CAUSED HIS CAR TO SPIN OUT. ONCE THE DEFENDANT''S VEHICLE
BEGAN DRIVING AGAIN HE CIRCLED AROUND THE TRACK, PASSING ALL THE
OTHER VEHICLES AND HE PULLED ALONG SIDE THE VICTIM''S VEHICLE
WHILE ON THE TRACK. BOTH VEHICLES WERE TRAVELING
AT APPROXIMATELY 15 TO 20 MILES PER HOUR, AND THE DEFENDANT
PULLED ABOUT A HALF CAR LENGTH IN FRONT OF THE VICTIM''S VEHICLE
WHERE HE/DEFENDANT THEN TURNED HIS VEHICLE WHEEL HARD RIGHT
CAUSING HIS VEHICLE TO CRASH INTO THE VICTIM''S VEHICLE. THE
VICTIM''S VEHICLE THEN CRASHED INTO THE CEMENT WALL, CAUSING
EXTENSIVE DAMAGE TO THE FRONT END.

I WITNESSED THE ENTIRE EVENT AND IT APPEARED THIS WAS AN
INTENTIONAL ACT, AS THE DEFENDANT WAS ABLE TO PASS ALL OTHER
VEHICLES EXCEPT THE VICTIM''S VEHICLE.

THE PARTS OF THE VICTIM''S VEHICLE WHICH WERE DAMAGED WERE THE
CHASSIS, FRONT SUSPENSION, FRONT BODY PANELS AND BUMPER, AND
THE RADIATOR. ALL DAMAGE ESTIMATED TO BE APPROXIMATELY $2000.00
TO $2500.00 WORTH OF DAMAGE.

I SPOKE WITH THE VICTIM AND HE ADVISED HE DID WISH TO PURSUE
CHARGES.

I MADE CONTACT WITH THE DEFENDANT WHERE HE WAS PLACED UNDER
ARREST AND TRANSPORTED TO THE CITRUS COUNTY JAIL FOR PROCESSING.

DEFENDANT''S BOND SET AT $1,000.00 PER BOND SCHEDULE.

Ok, so which is it? I can tune into Nascar on just about any Sunday and watch guys intentionaly ram each other and it's entertainment.........in this instance it's a misdemeanor. :shakehead

I remember a number of years ago when a NFL football player Charles Martin (long after the play) walked up to Jim McMahon and pile drived him. He should have been arrested if anybody is.

Seriously you get these jerks in sports who do criminal acts, they should not be beyond the reach of the law. 2 games suspensions are a joke, it's the real world and they should be held acountable.

Sounds as if this cracker cop's favorite driver was taken out and he stepped in to help out.

The Southern Saturday night short track fans won't like this.

But there is plenty of legal precedence forming for this sort of thing in sport.
