That tree clearly jumped out in front of him. He could take it to court, but his insurance company will probably swat the tree with a 5 figure settlement offer. :p

After seeing that video, the Russians are now heavily researching trees as a next generation anti-aircraft weapon. They just couldn't ignore the empirical results. ;)
